Personal Injury Lawyers in Truck Accident Claims

All too often, when a commercial truck is involved in an accident, the drivers and passengers of the smaller vehicles involved in the collision are often the most seriously injured. It may be a lot more difficult for a driver to see a smaller vehicle such as a car or a motorcycle. This is especially true during night time driving or in other weather conditions such as excessive sunlight or through heavy rain.

This graph from the ‘2011 Fatal road traffic crashes in Queensland report’ (‘2011 QLD Report’) illustrates the percentages of cars involved in fatal crashes:

There are many models of trucks that are on the road that can be involved in an accident. The most common types in Queensland defined by the 2011 QLD Report are:

Rigid trucks: A vehicle constructed primarily for load carrying with a gross vehicle mass (GVM) exceeding 4.5 tonnes.

Articulated trucks: A combination vehicle consisting of a prime mover or a rigid truck towing one or more trailers.

Road train: A combination vehicle (other than B-Doubles) consisting of a prime mover towing at least two trailers, or a rigid truck towing at least one trailer (a converter dolly supporting a semi-trailer counting as one trailer) where the whole combination of truck and trailer is longer than 19 metres, through designated routes.

Articulated trucks had the greatest rate of fatal crash involvement at 16.99% fatal crashes per 10,000 registered articulated trucks.

While most truck drivers are skilled and diligent in their operation of their vehicle, there may be irresponsible drivers who fail to abide by speed limits in order to meet a deadline. The risk may become more serious if the driver is on the road for a lengthy period of time and may be fatigued or tired.

Most trucking accidents are caused by human error or intoxication, mechanical failure or even operational failure from the company’s negligence in maintaining or inspecting their vehicles.
